This application is for grant of regular bail in connection with Terhagachh P.S.Case No.03 of 2017, registered for the offences under Sections 304B/34 of the Indian Penal Code. The petitioner is husband and the case is for dowry death as there is allegation of demand of dowry and cruelty. Submission of the learned counsel for the petitioner is that the post mortem report shows that the death is due to hanging, as such it is suicidal and no specific allegation has been attributed against the petitioner, who is husband.
Heard learned A.P.P. also, who has opposed the prayer for bail drawing my attention towards paragraph nos. 8, 9, 12 and 16 of the case diary and it is submitted that there is allegation of
Patna High Court Cr.Misc. No.25613 of 2017 (4) dt.10-07-2017 2/2 demand of dowry as well as cruelty and the postmortem report also supports the case of his unnatural death. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, considering the fact that he is in custody, the learned trial court is directed to expedite the trial of the petitioner.
With the aforesaid observation, this application is dismissed.
