The petitioner seeks bail in connection with Sessions Trial No. 362 of 2017 arising out of Samastipur Rail P.S. Case No. 15 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
31.5 litres of foreign liquor is said to have been recovered from the bag of the petitioner kept under his seat in the bogie of the train.
It is submitted by learned counsel for the petitioner that the petitioner is a lady. She has committed no offence and she has been falsely implicated in the case. She has no concern with

Though as per the F.I.R., she allegedly confessed that the said wine belongs to her, but the said confessional statement has no legal value, as it has not led to any recovery. The petitioner is languishing in custody since 23.03.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Judge Excise Act, Samastipur in connection with Sessions Trial No. 362 of 2017 arising out of Samastipur Rail P.S. Case No. 15 of 2017.
