The petitioner seeks bail in anticipation of his arrest in connection with Saraiya P.S. Case No. 715 of 2019 instituted for the offences under Sections 341, 323, 324, 325, 307, 379, 504, 506 and 34 of the Indian Penal Code.

The petitioner is alleged to have given a dagger blow on one Aftab as a result of which, he was injured. The learned counsel for the petitioner has submitted that the injury suffered by the aforesaid Aftab is not in consonance with the ocular testimony. Apart form this, it has been submitted that there is a counter version of the occurrence and in the counter case, persons from the side of the petitioner

Patna High Court CR. MISC. No.23336 of 2021(2) dt.24-05-2022 2/2 have also received injuries.

Regard being had to the afore-stated facts and taking into account that the occurrence took place without any premeditation and that also over a petty dispute, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IVcum-Sub Judge, Muzaffarpur, in connection with Saraiya P.S. Case No. 715 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Ashutosh Kumar, J) sunilkumar/- U T
