JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 08-06-2017 Heard Mr. Shivendra Prasad, learned counsel for the petitioner and Mr. Madan Kumar, learned Additional Public Prosecutor for the State.

The petitioner is being prosecuted in Pandaul P.S. Case No. 14 of 2017 alleged under sections 272, 273 of the Indian Penal Code read with sections 30 (a), 36, 38 (g) of the Excise Act. The seizure list would show that there is a seizure of 51.84 litres of foreign liquor manufactured at Haryana which was allegedly stored by the petitioner for the purposes of sale. The submission of the learned counsel for the petitioner is that the petitioner is in custody since 05.02.2017 and although he has one more case, vide Pandaul P.S. Case No. 46 of

Patna High Court Cr.Misc. No.25498 of 2017 (2) dt.08-06-2017 2/2 2009, but that was on different pretext and he is on bail in the said case.

Learned APP opposed the prayer for bail.

Considering the nature of allegations and giving sufficient time for completion of the investigation, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of like amount each to the satisfaction of the Special Judge-cum-1st Additional District Judge, Madhubani/Successor Court in connection with Pandaul P.S. Case No. 14 of 2017, G.R. No. 29 of 2017, subject to the condition that one of the bailors shall be a family member of the petitioner having no criminal antecedent.
