JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-05-2022 For the reason of this case not having been taken up even once for the last one year, a priority hearing is being given. Heard the learned counsel for the parties The petitioners seek bail in anticipation of their arrest in connection with Obra P.S. Case No. 19/2020 instituted for the offences under Sections 147, 149, 341, 323, 307, 379 and 504 of the Indian Penal Code.
The learned counsel for the petitioners has submitted that though they are alleged to have taken part in the assault but

Two persons, who are said to have been injured in the occurrence have received simple injuries. There is a land dispute between the parties and because of some event which had erupted in connection with such dispute, the allegations appear to have been overtly exaggerated.
Considering the afore-noted submissions on behalf of the petitioners and taking into account their clean antecedents, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad, in connection with Obra P.S. Case No. 19/2020, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
