2. This is the first regular bail application of the petitioner seeking his regular bail in connection with Sabour P.S. Case No. 397/2024 registered for the offence under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 140(1), 352, 351(4), 61(2) of B.N.S. Act and Sections 25(1-b)a, 9, 26,35,27 of the arms Act.

3. According to the case of prosecution, on 12.11.2024, on the basis of information received from the informant police officials reached on the spot. At that time 11 persons were caught hold along with injured Sita Ram Mandal, other 10-15 persons fled away from the spot. It is alleged that all of them were assaulted the injured Sita Ram Mandal and also

Patna High Court CR. MISC. No.15061 of 2025(3) dt.12-05-2025 2/3 fired on mob. On the basis of information received by the informant, an offence has been registered.

4. It is submitted by the learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in this case. Petitioner has no any criminal antecedent and he is in custody since 14.09.2024. He further submits that co-accused persons namely, Asan Mandal, Batoran Mandal, Gulcharan Mandal, Tetar Mandal, Tinku Mahaldar, Sikandar Mandal, Bambam Kumar, Pappu Mandal and Kailash Nishad have already granted benefit of bail by the Co-ordinate Bench of this Court, therefore, it is prayed on these grounds he may be also granted benefit of bail.

5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioner.

6. Considering the above submissions made by the learned counsel and particularly considering the fact that the some of the co-accused persons have already been granted benefit of bail, I am of the view that the petitioner should be enlarged on bail.

7. Accordingly, the application is allowed.

8. The petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
