JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2017 The petitioner seeks regular bail in connection with Darbhanga (Sitamarhi) Rail P.S. Case No. 13 of 2017, registered for offences punishable under Sections 20 and 22 of NDPS Act. Allegation is of recovery of 1.2 kg of ganja. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. Moreover, the alleged recovery is just more than the small quantity for which, he has already remained in custody for five and half months and has no criminal antecedent.
Heard learned A.P.P. also.
Having heard both sides, considering the fact that in this case more than the small quantity of ganja has been recovered from the possession of the petitioner, as such, at this stage, I am
Patna High Court Cr.Misc. No.27102 of 2017 (3) dt.18-07-2017 2/2 not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However a submission has been made that in this case charge has been framed, trial court is directed to expedite the trial and try to conclude it within a period of four months and if the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail in the court below, which will be considered by the court below on the materials available on the record.
