Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as also learned counsel, appearing for the informant.
The petitioner apprehends his arrest in connection with Supaul P.S. Case No. 205 of 2013 registered for the offence under Sections-406, 420, 384 & 120(B) of the Indian Penal Code. It would appear from perusal of the first information report that no specific overt act has been attributed against the petitioner and admittedly, an agreement for sale was executed by another accused.
The contention on behalf of the informant is that in course of investigation, it came to light that this petitioner
Patna High Court Cr.Misc. No.2115 of 2015 (2) dt.19-01-2015 threatened the witnesses.
Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Supaul P.S. Case No. 205 of 2013 to the satisfaction of Chief Judicial Magistrate, Supaul subject to conditions as laid down u/S 438(2) of the Cr. P.C.
