Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 307/34 of the Indian Penal Code.

The FIR and the case diary would reveal that father of the petitioner had given money to the petitioner to purchase land in the name of wife of the petitioner as well as wife of Sujeet Kumar, the brother of the petitioner. However, the petitioner purchased the land in the name of his wife only and for that dispute, the wife and children of Sujeet Kuamr sustained burn injury in the house. Allegation is that the petitioner and others burnt her. There is no eye-witness of the occurrence and

Patna High Court Cr.Misc. No.26947 of 2017 (7) dt.31-01-2018 2/2 considering the material in the case dairy co-accused Prabhu Narayan Singh has already been allowed bail by a Coordinate Bench of this Court vide order dated 20.12.2016 passed in Cr. Misc. No. 47220 of 2016.

Submission of the learned counsel for the petitioner is that nothing has come on the record that how the victim sustained burn injury. Therefore, it may be a case of suicide also.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sahebganj Police Station Case No. 207 of 2014, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
