1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Chandi Police Station Case No. 170 of 2024, disclosing offences under Sections 126(2), 115(2), 109, 303(2), 352, 351(2) of the BNS, 2023.

3. Learned counsel for the petitioner submits that petitioner no. 1 in Cr. Misc. No. 12865 of 2025 has been arrested, accordingly, seeks permission to withdraw the present application with respect to petitioner no. 1 in Cr. Misc. No. 12865 of 2025.

4. Permission is granted.

5. Accordingly, the present anticipatory bail application is dismissed as withdrawn with respect to petitioner no. 1 in Cr. Misc. No. 12865 of 2025.

6. As per the prosecution case, on 05.10.2024 in the evening, while the informant was talking with her family member (Gotani), suddenly due to dispute regarding passage, the petitioners and other accused persons arrived, started abusing the Gotani of the informant Paramshila Devi and started assaulting her and when the informant intervened to pacify the matter, they started assaulting the informant. The petitioner nos.

3/4 4 and 5 assaulted the informant's son near his stomach by legs where the informant's son was operated upon and due to the assault, her son started oozing blood from his mouth. It has further been stated that Satyendra Singh and Sanjay Kumar assaulted Paramshila Devi by means of knife.

Learned Counsel for the petitioners submits that both the parties are next door neighbors and there is a counter case lodged by the side of the petitioners also bearing Chandi PS case no. 171 of 2024. The injuries sustained by Paramshila Devi are simple in nature as would be evident from the injury report annexed at Annexure 2. Insofar as the injury caused to the son of the informant is concerned, it is submitted that from perusal of the impugned order, it appears that injury report was not produced by the Investigating Officer.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are neighbors having dispute regarding passage, case and counter case is there, the injuries sustained by Paramshila Devi are simple in nature and the injuries caused to the informant's son has not been brought on record by the prosecution, I am inclined to grant the petitioners privilege of anticipatory bail.

9. This application is, accordingly, allowed.

10. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Chandi Police Station Case No. 170 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
