The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 504, 323, 307, 448, 379, 427, 506/34 of the Indian Penal Code.

Learned counsel for the petitioners seeks permission to withdraw the petition with regard to petitioner No. 2 namely Shiv Singh since he has been arrested.

Permission is accorded.

Patna High Court CR. MISC. No.14193 of 2022(2) dt.08-09-2022 2/3 Accordingly, the petition with regard to petitioner No. 2 is permitted to be withdrawn. The prosecution case as per F.I.R is that in the background of a petty dispute, the accused persons including the petitioners assaulted the informant. It is specifically alleged against petitioner No. 1 that he instigated petitioner No. 2 to make assault to the informant, as a result of which, he assaulted the informant with iron rod on her head, as a result of which, she received head injuries. The accused persons also snatched gold chain of the informant.

It is submitted by learned counsel for the petitioners that in the background of some petty dispute, the present F.I.R has been registered. The accusation of assaulting the informant is against petitioner No. 2 who has been arrested by the police and his bail petition has been withdrawn. Moreover, the injuries of the informant have been found to be simple in nature. A statement has been made in para 3 of the petition that petitioner No. 1

In the facts and circumstance of the case, let the petitioner No. 1, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Bihiya P.S. Case No. 124 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
