JUSTICE ARVIND SRIVASTAVA ORAL ORDER 15-02-2022 Learned counsel for the petitioner no. 2 seeks permission to withdraw this application, since during the pendency of this application, he has been arrested. Permission is accorded.

Accordingly, the application of petitioner no. 2 Dani Yadav is dismissed as withdrawn.

Heard learned counsel for the petitioner no. 1 Manohar Yadav and the learned A.P.P. for the State. The petitioner apprehends arrest in connection with Gwalpara P.S. Case No. 117 of 2020 registered under Sections 147, 148, 149, 341, 323, 324, 325, 326, 307, 354, 448, 504 and 506 of the Indian Penal Code.

Patna High Court CR. MISC. No.23912 of 2021(3) dt.15-02-2022 2/2 Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. There is specific allegation against co-accused Manish Yadav and Dani Yadav. Petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner no.1 Manohar Yadav be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of A.C.J.M.-II, Udakishunganj, Madhepura in connection with Gwalpara P.S. Case No. 117 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
