The present writ petition has been filed for quashing the orders passed by the Circle Officer-cum-Block Supply Officer, Baheri vide letter nos. 149 and 150 dated 10.01.2014 and letter no. 151 dated 14.01.2014 (Annexure-1 series) by which several consumers of Anttodaya, B.P.L. and Kerosene oil attached with the shop of the petitioner have been shifted to other P.D.S shop dealers; and further for a direction to the respondent-Licensing Authority to make allotment in her name.
3. Learned counsel for the petitioner submits that several representations have been filed before the concerned authorities but to
Patna High Court CWJC No.7965 of 2014 dt.17-07-2018 2/2 no avail. It is submitted that that it will suffice if the petitioner is granted liberty to approach the Sub-Divisional Officer, Sadar Darbhanga, (Respondent No. 2) with a fresh representation for redressal of her grievances which may be directed to be decided, on its own merits and in the light of the Government Letter no. 844 dated 09.02.2011. In such event, the present writ petition need not be pressed on merits.
4. Learned counsel for the respondents appears and has been heard.
5. Having regard to the nature of the grievances and the stand of the petitioner, the present writ petition is disposed of granting liberty to the petitioner to file a fresh representation before the SubDivisional Officer, Sadar Darbhanga, (Respondent No. 2) for redressal of her grievances. If any such representation is filed within a period of two weeks from today, the same shall be considered and disposed of expeditiously and preferably within a further period of eight weeks thereafter in accordance with law.
