====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Hathauri Town P. S. Case No.144 of 2020, instituted for the offences under Sections 34, 323, 324, 307, 504 of the Indian Penal Code. It is alleged by the informant that his brother Akash Kumar was assaulted by the petitioner which led to deep incised wound and lacerated cut wound on neck, ear and fracture of ear cartilage with active bleeding.

The learned counsel for the petitioner submits that the petitioner and the informant are co-villagers and are next-door neighbour and having dispute between them as mentioned in Para-8 of the petition.

Learned A.P.P. submits that the injury report is

Learned counsel for the petitioner submits that the petitioner is in custody since 17.08.2020 and he is a person with clean antecedents. Charge-sheet has been submitted in this case. Because of the land dispute, the present occurrence took place in which the brother of the informant along with petitioner were injured.

Considering the facts afore-stated, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Deepak Kumar, learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Hathaurhi P. S. Case No.144 of 2020, subject to condition that if petitioner does not appear before the Court below on two consecutive dates, the learned Court below will be at liberty to cancel his bail bonds. The application stands allowed.
