JUSTICE PARTHA SARTHY ORAL ORDER 19-06-2020 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. The petitioner has filed this application for grant of anticipatory bail apprehending her arrest in connection with Raniganj P.S. Case no. 446 of 2019 registered under sections 420, 465 and 468 of the Indian Penal Code.

As per allegation in the FIR, it is stated that for the purpose of selection as Anganbari Sevika the petitioner had submitted forged mark sheet of secondary school examination. It is submitted by learned counsel for the petitioner that the allegation as levelled in the FIR are false. The fact is that the mark sheet of the petitioner has not been properly verified. It is further submitted that the petitioner has resigned from the job due to poor health and has not received a single penny by way of monetary benefit. She is a young lady having no criminal antecedent.

The application for bail is opposed by learned counsel for the State.

Having heard learned counsel for the parties and taking

Patna High Court CR. MISC. No.11839 of 2020(2) dt.19-06-2020 2/2 into consideration the facts and circumstances of the case specially the nature of allegation, the Court is inclined to enlarge the petitioner on anticipatory bail. The petitioner is directed to surrender in the Court below within a period of eight weeks from today and in the event of her arrest or surrender in connection with Raniganj P.S. Case no. 446 of 2019 she will be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Araria subject to the condition as laid down under section 438(2) of the Cr.P.C.
