2. The petitioner seeks bail in connection with Ujiarpur P.S. Case No. 69 of 2024 registered for the offence punishable under Sections 304B and 328 of the Indian Penal Code.

3. Though the petitioner is accused of demanding dowry and killing the deceased but the deceased and the petitioner had two children and it has been submitted by learned counsel for the petitioner that the children are staying with the family of the petitioner. The petitioner is in custody since 18.04.2024. The trial is being delayed.

4. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

5. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, Dalsinghsarai (Samastipur)/ concerned Court in connection with Ujiyarpur P.S. Case No. 69 of 2024.

6. At the time of accepting bail bonds of the petitioner, the Court below will verify as to whether the children are staying with the family of the petitioner or not. If it is found that the children are not staying with the family of the petitioner, the Court below shall not accept the bail bonds of the petitioner and if it is found that the children are staying with the family of the petitioner, his bail bonds shall be accepted by the Court below.
