JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 15-06-2017 Heard Sri Ashok Kumar Singh, learned counsel for the petitioner and Sri Sanjay Kumar Sharma, learned A.P.P. for the State. The petitioner in the present case is seeking regular bail in connection with Kutumba P.S. Case No. 52 of 2017 for offence registered under Sections 420, 467, 468 and 471 of the Indian Penal Code.

Learned counsel for the petitioner submits that a bare perusal of the First Information Report would show that the husband of the informant had admittedly handed over signed document to one Yogendra Prasad of village Bajitpur with a sum of Rs. 1000/- for the purpose of loan and it is said Yogendra Prasad, who got Rs. 50,000/- loan amount withdrawn illegally. There is no allegation against the present petitioner. Learned counsel further submits that petitioner is in custody since 18.04.2017 having clean antecedent. The name of the

Learned A.P.P. opposed the prayer for bail.

However, considering the facts and circumstances of the case and the fact that petitioner has clean antecedent and he has remained in custody for two months, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Kutumba P.S. Case No. 52 of 2017, subject to the condition under Section 437 (3) Cr.P.C.
