JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,447,379,504 and 506/34 of the Indian Penal Code and sections 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged that the accused persons damaged the boundary wall and pillar and uprooted the wheat crops and when protest was made by the informant and her husband the petitioners pushed the informant and abused by calling the caste name. It is submitted by learned counsel for the petitioners that in the background of serious land dispute the accusation has been levelled and Title Suit No. 47 of 2014 and Complaint Case No.
Patna High Court Cr.Misc. No.817 of 2015 (2) dt.09-01-2015 2/2 1282 of 2014 are pending between the parties. Considering the fact that in the background of serious litigated relationship the accusation has been levelled, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Banka in connection with Banka SC/ST P.S. Case No. 12 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
