JUSTICE ARUN KUMAR ORAL ORDER 29-03-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody since 29.1.2018, seek bail in Belaganj PS Case No. 22 of 2018 registered under Sections 419 and 420/34 of the IPC.
The allegation in brief is that the petitioners pledged jewelry to the informant, the jewelry shop owner, and received twelve thousand rupees but later on the informant suspected the genuineness of the jewelry and found it not a gold jewelry. Learned Counsel for the petitioner submits that the case was lodged after two days delay and the allegation is that the informant detained the petitioners at the shop on the very first day, more over the petitioners have no criminal antecedent.
Having considered the said facts and circumstances, the petitioners, namely, Satish Kumar and Nand Kishor Mistri are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM XI Gaya in connection with Belaganj PS Case No. 22 of 2018.
