JUSTICE SHIVAJI PANDEY ORAL ORDER 23-07-2020 Heard learned counsel for the petitioner and learned counsel for the State through Video Conferencing. In this case, the petitioner is seeking anticipatory bail in connection with Bairiya P.S. Case No. 413 of 2019 registered for offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

The police got a secret information and on that basis they intercepted a motor cycle and the person who looking to the police party threw the bag and started fleeing away and taking benefit of darkness they slipped away from there. The petitioner has been identified by the person around the area. The police has found 34 litres of liquor.

Looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and

Patna High Court CR. MISC. No.12385 of 2020(2) dt.23-07-2020 2/2 accordingly his prayer for bail is rejected. However, if the petitioner surrenders before the court below within eight weeks from today and prays for regular bail, the court below on the same day will take into consideration and pass order in accordance with law.
