The petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 34 of the Indian Penal Code and Section 30(a) of the Excise Act, 2016. The learned counsel for the petitioner submits that the petitioner is in custody since 30.11.2021, charge-sheet has been submitted in the case and has antecedent of six cases. Allegation is of recovery of 2399 litre of liquor from a container.

The learned counsel for the petitioner submits that petitioner was not arrested from the spot and his name came in the confessional statement of co-accused Lakhiindra Kumar, which has no evidentiary value.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and was not arrested from the spot and his name came in the confessional statement of co-accused, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Saraiya P. S. Case No.449 of 2021.

The application stands allowed.
