This application is for grant of regular bail in connection with Lakhanaur P.S.Case No.61 of 2015 corresponding to S.T.No.472 of 2016, registered for the offences punishable under Sections 396 and 397 of the Indian Penal Code. Petitioner is not named in the F.I.R and it appears that later on his name transpired on the confession of the co-accused. Submission of the learned counsel for the petitioner is that the petitioner is in custody for about one year and though sessions has commenced and it was assured by the learned counsel for the petitioner that he will produce witnesses on day-to-day basis but up-till-now no any witness has been examined. Heard learned A.P.P. also, who has opposed the
Patna High Court Cr.Misc. No.25785 of 2017 (4) dt.08-08-2017 2/2 prayer for bail stating that the case is under Section 396 and other Sections of the IPC.
Having heard both sides and in view of the fact that the trial has commenced, the learned trial court is directed to expedite the trial of the petitioner and try to conduct it on regular basis so that it may be concluded within a period of seven months. At the same time the S.P., Madhubani is also directed to ensure presence of the witnesses and to see that the trial be completed within the period as above.
Both the courts and the S.P., Madhubani are directed to strictly comply with the direction of this Court as above, otherwise they will have to face the consequences. With the aforesaid observation, this application is dismissed.
