Petitioner apprehends his arrest in connection with Rosera P. S. case no. 177/2014 registered under sections 457, 380 and 511 of the IPC.

Admittedly, petitioner was not caught on the spot and his name came in the statement of co-accused who was caught on the spot by the informant and others.

The submission on behalf of the petitioner is that there was love affair between the petitioner and sister of the informant and that is the reason of false implication of the petitioner in the alleged crime. Para 3 of this petition reveals that petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four

Chief Judicial Magistrate, Rosera, Samastipur in Rosera P. S. case no. 177/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
