The petitioner apprehends his arrest in a case registered for the offences punishable under Section 302/120B/34 of the Indian Penal Code.

The petitioner in association of 66 other co-accused is said to have killed the father and brother of the informant. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. No specific overt act has been levelled against the petitioner. He has no criminal antecedent. It is further submitted that similarly situated co-accused Saina

No.14111 of 2020(14) dt.27-06-2022 2/2 Kumar Das @ Saina Das and another have been enlarged on bail by a co-ordinate bench of this court vide order dated 17.10.2019 passed in Cr. Misc. No. 62005 of 2019 and other similarly situated co-accused have also been granted anticipatory bail by co-ordinate Bench of this Court vide order dated 16.07.2019 and 30.09.2019 passed in Criminal Miscellaneous Nos.43593and 62137 of 2019.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Narpatganj (Basmatiya) P.S. Case No. 281 of 2019, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
