1. Heard learned counsel for the petitioner, learned APP for the State and the learned counsel appearing on behalf of the informant.

2. The learned A.P.P., at the outset, submits that from perusal of the case diary, it would manifest that notice under Section 41(1)(b) of the Cr.P.C. has already been issued to the petitioner.

3. The learned counsel appearing on behalf of the petitioner submits that he was not instructed on the said issue and thus, seeks permission to withdraw the present anticipatory bail application with liberty to file a fresh, if need arises.
