The petitioners seek bail in a case instituted under Sections 147, 148, 149, 341, 342, 323, 324, 325, 307, 332, 333, 353, 427, 452, 379, 224, 225, 337, 338, 504 and 506 of the Indian Penal Code.

The prosecution story in brief, is that the petitioners along with other co-accused had attacked on the police personnel and set free the apprehended accused namely Md. Iliyas from lawful custody of the police. It has also been alleged that the accused persons snatched mobile phone of some police personnel

Patna High Court Cr.Misc. No.24904 of 2017 (2) dt.01-06-2017 2/2 and tried to snatch the firearms of the police personnel and damaged the police vehicles.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 21.03.2017. The petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The allegations levelled against the petitioners are general and omnibus in nature. The other co-accused have been granted bail vide Cr. Misc. No. 24248 of 2017 by another co-ordinate Bench of this court.

On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria in connection with Narpatganj P.S.
