JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 24-06-2020 Heard learned counsel appearing on behalf of the petitioner, learned counsel appearing on behalf of the State as well as learned counsel appearing on behalf of the Accountant General.

The petitioner retired on 31.05.2019 from the post of Compiler.

The grievance of the petitioner in the present writ petition relates to non-payment of post retiral dues with statutory interest.

Considering the fact that the petitioner retired on

Patna High Court CWJC No.4568 of 2020 dt.24-06-2020 2/2 31.05.2019, the writ petition is disposed of with direction to the respondents to take all necessary steps, if not already taken, with regard to the entitlement of claim of the petitioner and grant the benefits of first and second ACP and third MACP at the earliest preferably within a period of three months from the date of receipt/production of a copy of this order. If the post retiral dues are not finalised within the time frame as indicated above, the petitioner shall be entitled to interest at the rate of 9% per annum from the date of filing of the writ petition i.e. 27.02.2020 till the date of actual payment.

With the aforesaid observation and direction, the present writ petition stands disposed of.
