JUSTICE ARUN KUMAR ORAL ORDER 22-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Pipra Kothi PS Case No. 201 of 2017 registered under Sections 399, 402 of the IPC and Sections 25(1-b)A, 26 and 35 of the Arms Act.. Submission is that the alleged recovery from the possession of the petitioner is of one knife and mobile of the petitioner, besides this there is no other recovery and other co-accused from whose possession mobiles were recovered namely Abinash Kumar, Raushan Kumar, Mintu Kumar and Ayush Reddy have been admitted to bail by coordinate Benches of this Court and the petitioner is in custody since 8.10.2017.
Having considered the said facts and circumstances, the petitioner, namely, Prakash Yadav @ Om Prakash Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Motihari, East Champaran in connection with Pipra Kothi PS Case No. 201 of 2017 on the following conditions: (i) one of the bailors must be a close family member of the petitioner;
Patna High Court Cr.Misc. No.16094 of 2018 (2) dt.22-03-2018 (ii) The petitioner is directed to appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
