Petitioner is languishing in custody since 17.11.2016 in connection with Town (Hajipur) P.S. Case No. 791/16 for offences punishable under Section 414 of the Indian Penal Code. The prosecution case, as lodged by the police personnel, is that during course of checking of vehicles, the petitioner was found fleeing away on a motorcycle. On being apprehended, he could not show the documents of the motorcycle. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal antecedent and has been falsely implicated in the aforesaid case. He submits that

Patna High Court Cr.Misc. No.35240 of 2017 (2) dt.11-08-2017 2/2 charge-sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses by the petitioner and that considering the period of custody a sympathetic consideration be given.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Town (Hajipur) P.S. Case No. 791/16.
