2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 126(2), 115(2), 118(1), 109, 351(2), 352/3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, all the FIR named accused persons including this petitioner surrounded the informant and assaulted his nephew by means of knife.
4. It is submitted on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case. Doctor has found simple injury. Allegation of assault is general and omnibus against this petitioner and no specific overt act has been alleged against him. Petitioner claim clean antecedent.
5. Learned counsel for the State opposes the prayer
Patna High Court CR. MISC. No.20609 of 2025(2) dt.23-04-2025 2/2 for bail.
6. Considering the aforesaid facts of the case, prayer for bail of all the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in Chapra Town Police Station Case No. 688/2024, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
