Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 341, 323, 307, 302 and 504 of the Indian Penal Code.

According to FIR, the petitioner assaulted with Khanti causing injury at the head of the uncle of the informant and when the injured fell down co-accused Kabindra Jamadar assaulted with iron rod causing injury at the head. Subsequently, the victim died. The Doctor has found single injury on the scalp which was contusion caused by hard blunt substance. On dissection fracture etc. were found besides clotting of blood. Though the prosecution witnesses have supported the aforesaid fact before the police, however, the medical report does not

Patna High Court Cr.Misc. No.9052 of 2018 (3) dt.26-03-2018 2/2 corroborate that two injuries were caused to the deceased and even if the medical report is taken as it is the allegation goes to coaccused Kabindra Jamadar. Learned counsel for the informant opposed the prayer for bail.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Telhara Police Station Case No. 127 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
