JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,504 and 354B/34 of the Indian Penal Code.

The basic accusation is of giving threat to life to the informant for demanding share in the property and making assault to the informant when husband of the informant came to rescue then the petitioner being uncle of the informant assaulted him with fists and slaps.

It is submitted by the learned counsel for the petitioner that in the background of share dispute the accusation has been levelled. It is further submitted that even assuming the accusation no case under section 354B

Patna High Court Cr.Misc. No.10428 of 2016 (2) dt.04-03-2016 2/2 IPC is made out.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda at Biharsharif in connection with Chhabilapur P.S. Case No.127 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
