Heard the learned counsel for the petitioners and the State.

The petitioners, who are employees of the Cooperative Spinning Mills Limited, Pandaul, in the district of Madhubani, are aggrieved by the fact that they have not been

Patna High Court CWJC No.4315 of 2019 dt.08-03-2019 2/3 paid the arrears of salary from November, 1991 to July, 1992 and March, 2000 to December, 2012. The petitioners have also raised grievance that the money, which was deposited by them under the Employees Provident Fund Scheme, 1952, since they had been working in the aforesaid Co-operative Spinning Mill, Pandaul since 21.10.1986, has also not been paid to them.

Learned counsel for the petitioners has also drawn the attention of this Court that even the Industries Department had issued necessary instructions to the concerned Spinning Mill to clear the backlogs of payment to which the petitioners are entitled. However, despite that, the petitioners have not been paid their dues without any valid reason. This Court, though takes note of the fact that the petitioners are the employees of a Co-operative Spinning Mill, which may not be amenable to a writ jurisdiction but since a direction had been issued by the Industries Department to clear the payment of the petitioners, this Court only directs the petitioners to make a representation before the General Manager, Co-operative Spinning Mills Ltd., Pandaul, District -

Patna High Court CWJC No.4315 of 2019 dt.08-03-2019 3/3 Madhubani, who shall look into the matter and dispose off the representation of the petitioners towards redressal of their grievances.

With the aforesaid observation / direction, this petition stands disposed off.
