Having regard to the fact that the petitioner claims appointment or continuation on the post of Sweeper in the establishment of Bharat Sanchar Nigam Limited (B.S.N.L.), this Court will have no difficulty in holding this writ application to be not maintainable because for such relief the petitioner ought to have moved Central Administrative Tribunal constituted under the Administrative Tribunal Act, wherein, under Section-14 of the Administrative Tribunal Act, B.S.N.L., is also a notified Corporation.

Patna High Court CWJC No.8141 of 2014 (2) dt.20-02-2015 Learned counsel for the petitioner, however, at this stage having realized that this writ application is not maintainable before this Court without exhausting the statutory alternative remedy before the Central Administrative Tribunal, seeks permission to withdraw this application in order to enable the petitioner to move before the Central Administrative Tribunal for redressal of the grievance raised herein.

That being so, this application is permitted to be withdrawn with the aforementioned liberty.
