The petitioner seeks bail in connection with Ben P.S. Case No. 105 of 2019, registered under Section 354(B) of the Indian Penal Code and Section 8 / 12 of the Protection of Children from Sexual Offences Act.

The accusation is that daughter of informant, aged about 15 years, had gone on roof of the adjacent house, at that time, this petitioner reached there and caught hold her, dashed her and tried to outrage her modesty. On raising alarm by her daughter, Guddu Yadav, son of informant, reached there and removed the petitioner then petitioner fled away. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.13853 of 2020(2) dt.03-03-2020 2/2 petitioner and informant are next door neighbour and due to petty dispute, the petitioner has falsely been implicated in this case. The petitioner has no criminal antecedent and he is in custody since 20.08.2019.

On the other hand, learned counsel appearing on behalf of informant submits that after framing the charge, four witnesses have already been examined in this case. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda in connection with Ben P.S.
