====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 02-04-2025 Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners apprehend their arrest in connection with Halsi P.S. Case No. 323 of 2024, registered for the offences punishable under Sections 115(2), 126(2), 118(1), 109, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.

3. As per allegation, the petitioners and the co-accused persons assaulted the informant and her family members.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated. There is case and counter case relating land dispute and son of petitioner no. 2 (co-accused, Dipu Kumar) has also

Patna High Court CR. MISC. No.15598 of 2025(2) dt.02-04-2025 2/2 suffered grievous injuries. He has submitted further that the petitioner no. 1 is a lady and petitioner no. 2 is an old person of 71 years of age and the allegations are general and omnibus.

5. On the other hand, learned APP for the State opposes the prayer for bail of the petitioners.

6. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Halsi P.S. Case No. 323 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.
