2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 109(1) & 3(5) of the BNS and under Sections 3 & 4 of the Explosive Substance Act. Further added Section 103(1) of the BNS.

3. The case of the prosecution is that during examination being conducted at B.N. College, Patna, some miscreants hurled bomb and one student got injured who later on succumbed to the injuries. The principal of B.N. College, Patna requested the police to take action.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted that the

Patna High Court CR. MISC. No.13894 of 2026(2) dt.25-02-2026 2/3 name of this petitioner has surfaced during course of investigation in the confessional statement of one Prakash Chandra Prabhat. Learned counsel for the petitioner has submitted that from perusal of Annexure-P/2 it goes to show that the petitioner was appearing in examination in College of Commerce, Patna from 10:00 A.M. to 01:00 P.M. It has further been submitted that the marksheet is at page 19 which goes to show that the petitioner has passed that exam. Learned counsel for the petitioner has submitted that save and except confessional statement of Prakash Chandra Prabhat, there is nothing against the petitioner and Prakash Chandra Prabhat has been granted bail by this Court vide Cr. Misc. No. 89189 of 2025. The case of this petitioner stands on better footing. Learned counsel has lastly submitted that the petitioner is languishing in judicial custody since 30.11.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail and has submitted that the petitioner is having criminal antecedent of three cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with

Patna High Court CR. MISC. No.13894 of 2026(2) dt.25-02-2026 3/3 Pirbahore P.S. Case No. 368 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna.
