Petitioner apprehends his arrest in connection with Jagdishpur P. S. case no. 287/2014 registered under sections 3 (3), 7, 2 (iii) and other allied sections of the Fertilizer Control Act as well as section 7 of the E.C. Act.

Admittedly, petitioner was retail dealer of fertilizer and 190 bags of urea had been entered into store register but only 13 bags urea was found in the shop of the petitioner when the concerned officials inspected the concerned shop and local customers made complain to the concerned officials that the petitioner used to sell urea on higher rate.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let

Patna High Court Cr.Misc. No.2838 of 2015 (2) dt.21-01-2015 the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Jagdishpur P. S. case no. 287/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
