JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered under Sections 406 and 409 of the Indian Penal Code. The allegation against the petitioners is that they have defalcated Rs. 9,63,000/- of cash credit and interest accrued of Rs. 3,57,000/- over it.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The petitioners have been made accused due to mistake of fact. There is no substantive evidence to show the implication of the petitioners in the present case. It is further submitted that the petitioners are ready to deposit an amount of Rs. 1,50,000/-(one lac and fifty thousand only) in

Patna High Court Cr.Misc. No.11073 of 2016 (2) dt.25-04-2016 2/2 the court below, which shall be subject to final disposal of the case.

On behalf of the State, it is submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, the petitioners are directed to deposit an amount of Rs. 1,50,000/-(one lac and fifty thousand) in the court below, which shall be subject to final disposal of the case.

Let the above named petitioners, in the event of their arrest/surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bikramganj in Bikramganj P.S.Case No. 186 of 2015,subject to the conditions as laid down u/s 438(2) Cr.P.C.
