Petitioner is languishing in custody in connection with Ghoghardiha P.S. Case No. 04/16, G.R. No. 57/16 for offences punishable under Sections 302, 201, 120-B of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that his niece Radha Devi was married to the petitioner eight years back and had three children and due to some dispute all the in-laws including the petitioner conspired and killed his niece.
It has been submitted by the learned counsel for
Patna High Court Cr.Misc. No.26378 of 2017 (3) dt.25-07-2017 2/3 the petitioner that he is innocent, has falsely been implicated in the aforesaid case, general and omnibus allegation has been levelled and the police during investigation have found that the petitioner works in Delhi and the deceased used to live with the in-laws and dewar in the village. It is further submitted that the charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.
However, learned APP for the State opposes the prayer for bail.
Be that as it may, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jhanjharpur, Madhubani in connection with Ghoghardiha P.S. Case No. 04/16, G.R. No. 57/16, subject to the condition that one of the bailors would be a close relative of the petitioner, who would have sufficient immovable property within the jurisdiction of the concerned police station, who will file an affidavit stating his relationship with the petitioner and that petitioner will appear before the learned court below during trial as and when
Patna High Court Cr.Misc. No.26378 of 2017 (3) dt.25-07-2017 3/3 required and failure to appear on two consecutive dates without assigning any reason will entail cancellation of his bail bonds.
