Petitioner seeks bail in Sanhaula P.S. Case No.159 of 2018 instituted for the offence under Section(s) 384, 386, 401/34 Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.

In the written report, it is alleged that police got information that some miscreants are forcibly collecting money from the truck drivers at lonely place. The police went to the place of occurrence and arrested this petitioner with two other persons. It is further alleged that one country made loaded pistol was recovered from possession of co-accused Deepak Kumar. Counsel for the petitioner submits that there is no recovery from possession of the petitioner.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Sanhaula P.S. Case No.159 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
