The petitioner seeks bail in connection with Amba P.S. Case no. 167 of 2017 registered under Sections 30(a)/38 of the Bihar Excise and Prohibition Act 2016.

46 lts. of country made liquor is said to have been recovered from the bag kept on the scooty of the petitioner and petitioner was apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. Petitioner has been falsely implicated in the case at the instance of his enemies by planting the aforesaid recovery from his scooty. He has no concern with the seized

Patna High Court Cr.Misc. No.8528 of 2018(2) dt.17-02-2018 2/2 liquor. He has no criminal antecedent. He has been languishing in custody since 29.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VII-cum-Special Judge (Excise), Aurangabad in connection with Amba P.S.
