The petitioners seek bail in connection with Banka (Barahat) P.S. Case No.174 of 2018 registered under Section 30(b) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on being apprehended by the police and on being tested by breath analyzer, the petitioners were found consuming liquor.
Learned counsel for the petitioner submits that there is no recovery of liquor from the possession of the petitioners rather it is alleged that on being apprehended by the police and on being tested by breath analyzer, they were found consuming liquor.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Banka, in connection with Banka (Barahat) P.S.
