The petitioner has preferred this application for grant of regular bail in a case registered under Sections 399, 402, 413 of the Indian Penal Code and Section 25(1-b)A, 26, 35 of the Arms Act.
On the basis of the secret information, the police raided the place of occurrence and apprehended two miscreants who disclosed their name as Mithilesh Kumar Yadav and Md. Mazhar and they also disclosed the name of the other accused persons who fled away from the place of occurrence. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in
Patna High Court CR. MISC. No.14452 of 2022(2) dt.06-07-2022 2/2 this case. No incriminating article has been recovered from the possession of the petitioner. He is also accused in one more criminal case in connection with Korha P.S. Case No. 357 of 2021 and the petitioner is in custody since 25.09.2021. Learned A.P.P. for the State has opposed the bail petition of the petitioner. Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Katihar in connection with S.T. No. 364 of 2021arising out of Korha P.S. Case No. 360 of 2021, with a following condition:-
1. The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner will liable to be cancelled. The application stands allowed.
