Petitioner seeks bail in connection Patahi P.S. Case no. 90 of 2020 registered for the offence punishable under sections 341, 323, 324, 307, 359, 354(b), 504 and 506/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is in custody since 08.12.2020, charge sheet has been submitted and petitioner is person with clean antecedent and from bare perusal of the allegation as alleged in the FIR, it would manifest that petitioner has been attributed with allegation that he assaulted with farsa on head of the informant's mother, namely, Keshwari Kunwar. Learned counsel for the petitioner draws the attention of the court towards the impugned
Patna High Court CR. MISC. No.24231 of 2021(2) dt.17-11-2021 2/2 order whereas injury on the mother of the informant is clean edged wound on scalp with excessive bleeding. Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody since 08.12.2020, charge sheet has been submitted and petitioner is a person with clean antecedent, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in Patahi P.S.
