Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Beldaur P.S. Case No. 48 of 2019, registered for the offences punishable under Sections 341, 323, 379, 506 and 353/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the co-accused Rakesh Kumar has already deposited Rs. 2190/-, the loss sustained by the North Bihar Power Distribution Company Limited. He has further submitted that the petitioner is on police bail. Considering the above-mentioned facts and circumstances, the petitioner is directed to surrender before the court

No.13937 of 2022(2) dt.11-10-2022 2/2 below and make a prayer for regular bail, that shall be considered on the same day of its filing without being prejudiced by this order. The learned court below may take notice of the fact that the petitioner is on police bail and he is a person of clean antecedent. With these observations, the criminal miscellaneous petition is disposed of.
