JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-05-2023 Heard learned counsel for the petitioner and learned counsel for the Bihar Staff Selection Commission, Bihar, Patna. Petitioner, in the present case, is seeking a writ in the nature of writ of mandamus commanding the respondent authorities to issue an appointment letter in favour of the petitioner for the post of Intermediate Assistant. It is the case of the petitioner that he had applied for the post advertised for the Scheduled Caste Category. In the result published by the Commission the petitioner was not shown qualified despite the fact that he had scored 284 marks.

Patna High Court CWJC No.3459 of 2023(2) dt.12-05-2023 2/2 Learned counsel for the petitioner submits that respondent no. 4, who has been selected under the same category, has scored only 272 marks. In this connection, he relies upon Annexure '4' to the writ application. Learned counsel submits that the petitioner has filed a detail representation annexing the entire documents before the Chairman/Secretary of the Commission but the same is not being considered.

Having regard to the submissions noted hereinabove, without going into the merit of the contentions, this Court directs the Chairman, Bihar Staff Selection Commission, Bihar, Patna (respondent no. 2) to consider the representation of the petitioner as contained in Annexure '5' to the writ application and pass a reasoned order thereon within a period of three months from the date of receipt/production of a copy of this order.

This Writ Application stands disposed of.
