Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Sidhwaliya P.S. Case No. 01 of 2022 instituted for the offences under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
Learned counsel for the petitioner submits that the petitioner is in custody since 03.01.2022, is a person with clean antecedent and charge-sheet has been submitted. Allegation is of recovery of five litre of liquor along with article used for packing the liquor.
Learned counsel for the petitioner submits that petitioner was arrested from the spot while two accused fled
Patna High Court CR. MISC. No.13166 of 2022(2) dt.22-03-2022 2/2 away. It is submitted that petitioner was a passerby and came to be implicated showing his presence at the place of occurrence. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted, let the petitioner above named be released on bail on furnishing bail bond of Rs.500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Excise Court No. 1, Gopalganj in connection with Sidhwaliya P.S. Case No. 01 of 2022.
