The petitioner seeks bail in connection with Kowakole P.S. Case no. 161 of 2017 registered under Section 30(a) of the Bihar Excise and Prohibition Act 2016.

10 lts. of country made liquor is said to have been recovered from the rear side of the house of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession rather from the lane located on the rear side of the house of the petitioner which is accessible to public at large. He has no concern with the seized liquor. Though, one more case under Excise Act has been lodged against the

Patna High Court Cr.Misc. No.8631 of 2018(2) dt.19-02-2018 2/2 petitioner after the case under hand, but he is on bail in the said case. He has been languishing in custody since 20.12.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-cumSpecial Judge, Nawada in connection with Kowakole P.S. Case no. 161 of 2017.
