JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-08-2015 The petitioner, an accused in Bihta P.S.Case No.938 of 2014 registered under section 498-A of the Indian Penal Code as well as sections 3 and 4 of the Dowry Prohibition Act, seeks a direction from this Court to be issued to the respondent authorities to hand over the case either to the CBI or to the CID for a fair and impartial investigation. In my view, the application is thoroughly misconceived. An accused in a criminal case cannot choose the investigating agency for investigation of his case.
